L&#8217;Abonn\u00e9 choisira la licence \u00e0 souscrire en fonction du nombre de postes vacants actifs. More information about the different licenses can be found on our Site. Apr\u00e8s avoir choisi une licence, la possibilit\u00e9 de publier des offres d&#8217;emploi via la Plateforme sera limit\u00e9e au nombre d&#8217;offres d&#8217;emploi autoris\u00e9es via la licence. Si vous avez plus de postes vacants, vous pouvez mettre \u00e0 niveau la licence. Le surclassement sera effectif d\u00e8s que le paiement aura \u00e9t\u00e9 accept\u00e9. Il n&#8217;y aura aucun remboursement lorsque l&#8217;Abonn\u00e9 souhaite r\u00e9trograder de temps en temps car l&#8217;Abonn\u00e9 a moins de postes vacants qu&#8217;initialement activ\u00e9s. Le d\u00e9classement commence le lendemain de la date d\u2019expiration de la licence initiale.<\/li>\n<li>Lorsqu&#8217;il accepte nos Conditions et s&#8217;abonne \u00e0 notre Plateforme, l&#8217;Abonn\u00e9 devra s&#8217;inscrire avec une adresse e-mail valide, le nom de l&#8217;entreprise, l&#8217;adresse de l&#8217;entreprise, le num\u00e9ro de t\u00e9l\u00e9phone de l&#8217;entreprise et les informations de facturation. Les donn\u00e9es fournies doivent \u00eatre vraies et exactes. Si les donn\u00e9es ne sont pas vraies ou exactes, nous nous r\u00e9servons le droit de refuser \u00e0 l&#8217;Abonn\u00e9 d&#8217;activer le compte ou de suspendre ou de r\u00e9silier nos services \u00e0 tout moment, sans aucun remboursement ni compensation pour l&#8217;Abonn\u00e9.<\/li>\n<li>L&#8217;Abonn\u00e9 est responsable du maintien de la s\u00e9curit\u00e9 du compte et du mot de passe pour garantir que le compte ne peut pas \u00eatre utilis\u00e9 sans l&#8217;autorisation de l&#8217;Abonn\u00e9. Jobtoolz ne pourra \u00eatre tenu responsable de toute perte ou dommage d\u00fb \u00e0 un piratage du compte car le mot de passe n&#8217;a pas \u00e9t\u00e9 choisi avec soin. Nous vous conseillons de choisir un mot de passe d&#8217;au moins 8 caract\u00e8res combinant lettres et chiffres et caract\u00e8res sp\u00e9ciaux. Le mot de passe est strictement personnel et l&#8217;Abonn\u00e9 est enti\u00e8rement responsable de sa sauvegarde. Le compte ne peut \u00eatre partag\u00e9 ou c\u00e9d\u00e9 \u00e0 des tiers. Nous vous conseillons \u00e9galement fortement d\u2019activer 2FA. Ceci peut \u00eatre activ\u00e9 dans les param\u00e8tres personnels.<\/li>\n<li>La Plateforme ne peut \u00eatre utilis\u00e9e \u00e0 des fins non autoris\u00e9es ou ill\u00e9gales. L&#8217;Abonn\u00e9 est enti\u00e8rement responsable du respect des lois de sa juridiction et devra s&#8217;assurer que l&#8217;utilisation de notre Plateforme sera conforme \u00e0 toutes les lois et l\u00e9gislations applicables (notamment, mais sans s&#8217;y limiter, la l\u00e9gislation belge et europ\u00e9enne sur la protection des donn\u00e9es). L&#8217;Abonn\u00e9 doit nous informer imm\u00e9diatement s&#8217;il prend connaissance d&#8217;une utilisation inappropri\u00e9e ou non autoris\u00e9e de la Plateforme. Nous nous r\u00e9servons le droit de suspendre ou de mettre fin imm\u00e9diatement \u00e0 l&#8217;acc\u00e8s \u00e0 la Plateforme en cas d&#8217;utilisation inappropri\u00e9e ou non autoris\u00e9e de la Plateforme par ou du fait de l&#8217;Abonn\u00e9. Tous les co\u00fbts, d\u00e9penses et pertes directs ou indirects (y compris le manque \u00e0 gagner) r\u00e9sultant de toute utilisation inappropri\u00e9e ou non autoris\u00e9e de la Plateforme par ou du fait de l&#8217;Abonn\u00e9 (tels que, mais sans s&#8217;y limiter : le piratage par l&#8217;Abonn\u00e9, l&#8217;utilisation de vers ou de virus , etc.) seront int\u00e9gralement factur\u00e9s \u00e0 l\u2019Abonn\u00e9.<\/li>\n<li>Jobtoolz se r\u00e9serve le droit d\u2019utiliser le nom de l\u2019Abonn\u00e9 comme r\u00e9f\u00e9rence client envers des tiers. L\u2019Abonn\u00e9 accorde \u00e0 Jobtoolz une licence mondiale et libre de droits pour publier le nom de l\u2019Abonn\u00e9 sur le site Web d\u2019information de Jobtoolz.<\/li>\n<\/ol>\n<p><strong>Soutien<br \/>\n<\/strong><\/p>\n<ol>\n<li>Chaque fois que l&#8217;Abonn\u00e9 a besoin d&#8217;assistance ou d&#8217;aide, l&#8217;\u00e9quipe d&#8217;assistance est disponible via hallo@jobtoolz.be. Nous ferons tout ce qui est en notre pouvoir pour r\u00e9pondre dans un d\u00e9lai d&#8217;un jour ouvrable. Bien que Jobtoolz ne puisse pas garantir une r\u00e9solution du probl\u00e8me dans un d\u00e9lai d&#8217;un jour ouvrable (par exemple pour des probl\u00e8mes techniques), Jobtoolz fera tout ce qui est en son pouvoir pour r\u00e9soudre le probl\u00e8me dans un d\u00e9lai raisonnable.<\/li>\n<li>Jobtoolz fera tous les efforts raisonnables pour garantir que la Plateforme soit disponible \u00e0 tout moment. Cependant, il peut arriver que la Plateforme soit interrompue pour des mises \u00e0 jour, une maintenance ou en raison d&#8217;une panne (congestion du r\u00e9seau, probl\u00e8mes de t\u00e9l\u00e9communication, etc.). Jobtoolz fera tout ce qui est en son pouvoir pour minimiser les temps d&#8217;arr\u00eat. En cas d&#8217;indisponibilit\u00e9 pour des raisons ind\u00e9pendantes de la volont\u00e9 de Jobtoolz, Jobtoolz ne peut \u00eatre tenu responsable.<\/li>\n<li>Jobtoolz se r\u00e9serve le droit de mettre \u00e0 jour ou de modifier la Plateforme de temps \u00e0 autre, sans aucune approbation de l&#8217;Abonn\u00e9. Jobtoolz s&#8217;engage \u00e0 am\u00e9liorer la Plateforme et \u00e0 mettre \u00e0 jour la Plateforme r\u00e9guli\u00e8rement.<\/li>\n<\/ol>\n<p><strong>Services<\/strong><\/p>\n<ol>\n<li>The Platform includes the possibility to advertise vacancies on external jobboards or social media. An additional fee can be charged for such services, and will be communicated during the ordering process. Please note that Jobtoolz has no control over the processes used by such third parties. Jobtoolz cannot be held responsible for any delay in the publishing or for rejection of such advertisements, for any or no reason whatsoever. Jobtoolz cannot be held responsible for the results or the lack of results of third parties.<\/li>\n<\/ol>\n<p><strong>Warranty<\/strong><\/p>\n<ol>\n<li>Jobtoolz warrants that the Platform shall be provided with the reasonable care which would be expected from a trustworthy provider. However, Jobtoolz does not warrant that the Platform will be free of errors, bugs or interruptions. All software contains bugs. As Jobtoolz also relies on third parties (such as, but not limited, hosting provider, telecommunication providers, etc.) Jobtoolz cannot be liable in any way for failures in their service.<\/li>\n<li>Except as otherwise provided, Jobtoolz excludes all warranties of merchantability, non-infringement of intellectual property and fitness for a particular purpose.<\/li>\n<li>Jobtoolz guarantees that the data given by the applicant, such as personal information and CV, will not be given to third parties. As such the Subscriber is responsible for the data received by the applicant. Jobtoolz will provide a GDPR module which gives the possibility to anonymize or delete the personal details of the applicant after a certain period of time. The Subscriber is responsible to keep data in accordance to the GDPR law.<\/li>\n<\/ol>\n<p><strong>Limitation of liability<\/strong><\/p>\n<ol>\n<li>Jobtoolz shall not be liable for any loss of profit, loss of revenue, loss of data and loss of reputation resulting from the Platform.<\/li>\n<li>Jobtoolz shall not be liable for the content and the effects this content may have on the Subscriber or third parties. The Subscriber accepts full liability for the content of their jobsite, made through the Platform.<\/li>\n<li>The Subscriber is responsible for keeping its computer up to date, in particular with respect to the latest security aspects. Jobtoolz shall not be liable for the issues or malfunctioning of the Platform due to any lack thereof by or due to the Subscriber.<\/li>\n<\/ol>\n<p><strong>Intellectual property rights<\/strong><\/p>\n<ol>\n<li>Jobtoolz owns all intellectual property rights relating to the Platform. Jobtoolz grants the Subscriber a non- exclusive royalty-free license to use the Platform. The Subscriber is not allowed to copy, modify, reproduce the Platform in any way nor to sell any content relying to the Platform.<\/li>\n<li>The Subscriber shall indemnify and hold Jobtoolz harmless against all losses, costs and expenses arising from or incurred by reason of any infringement of any intellectual property right by or due to the Subscriber.<\/li>\n<\/ol>\n<p><strong>Payments<\/strong><\/p>\n<ol>\n<li>Jobtoolz offers a free trial period of 14 days. After the free trial period, the Subscriber will need a valid credit card to activate the license into a paying account. The license will be charged in advance on a monthly or yearly base.<\/li>\n<li>All license fees are exclusive of all taxes, levies or duties. The Subscriber shall be responsible for payment of those taxes, levies or duties.<\/li>\n<li>Any dispute concerning an invoice send by Jobtoolz must be lodged within 7 days of the invoice date. Once the date expired the invoice shall have been accepted irrevocably.<\/li>\n<li>Jobtoolz offers the possibility to run campaigns through the platform or through our digital marketeers. The correct prices are always listed in the app or on the marketplace. Price changes are not communicated in separate letters to the customer, as the app and\/or the marketplace reflect the current correct price at the time of the order. Price discussions regarding posted prices of the campaigns will not be accepted.<\/li>\n<li>For each invoice that has not been paid in full or in part by the Customer on the due date, the latter is liable to pay \u2013 by operation of law and without prior notice of default \u2013 late payment interest of 1% per month in arrears, whereby a month that has already started is to be considered as fully completed, while the amount due will be increased with all collection costs paid by Jobtoolz in connection with the collection of the debt, plus 20% of the invoice amount, with a minimum of \u20ac 150 (excl. VAT) by way of lump sum damages, without prejudice to Jobtoolz right to claim higher compensation.<br \/>\nIf the Customer fails to pay one or more invoices, Jobtoolz has the right to temporarily suspend the access to the Services until it has received actual and full payment from the Customer. However, the temporary suspension of access to the Services does not affect the continuation of the Term. Moreover, Jobtoolz may unilaterally terminate the Agreement if the Client fails to pay or is repeatedly late in paying.<br \/>\nLate payment or non-payment will result in all other invoices of Jobtoolz to the Customer immediately becoming due and payable, even if they have not yet fallen due, and all permitted payment conditions will cease to apply. The same applies in the event of an imminent bankruptcy, judicial or amicable dissolution, suspension of payment, as well as any other fact showing that the Customer is insolvent.<\/li>\n<li>Every year, an optional index can be applied on the licence.<\/li>\n<\/ol>\n<p><strong>Term and termination<\/strong><\/p>\n<ol>\n<li>Licences are granted for a period of one month from the date of activation and are renewed automatically, unless one of the parties cancels at least 15 days before the expiry date of the current one-month period. The Subscriber can terminate his licence at any time by cancelling the subscription to the Site. The termination will be effective from the first day after the current one-month period. No refunds will be given upon termination. Licences that are paid for annually can only be deactivated at the end of the licence year. In the case of annual licences, the cancelling party should also do this no later than 15 days before the start of the new licence period via &#8216;stop license&#8217; in the Jobtoolz dashboard. No refunds will be made if the licence is cancelled before the annual expiry date. Invoices for tacit renewals will be sent 14 days before the start of the new licence and must be paid if a correct cancellation was not made at the latest 15 days before the renewal of the licence. No exceptions to this can be granted.<\/li>\n<li>Upon termination, Jobtoolz will deactivate Suscriber access to the Platform.
